Terms of use

1. Welcome to Healio Health

By accessing or using healiohealth.com.au and any services, content, or products provided on or through this website (together, the "Service"), you agree to comply with and be bound by these Terms and Conditions ("Terms"). These Terms are entered into by and between you and Healio Health ("we", "our", or "us"). Our Privacy Policy also applies to your use of the Service.

2. Using Our Service

2.1 Purchases

When buying any product or service through our Service, you may be asked to provide information such as your payment details and contact information. By submitting this information, you warrant:

  • You have legal authority to use the provided payment method.

  • All information you supply is accurate and complete.

We may use third parties to process payments securely. We reserve the right to refuse or cancel any order—at our sole discretion—including for service availability, inaccuracies, suspicion of fraud, or if required by law.

3. Certificate Information – Role of Pharmacists and Registered Nurses

Pharmacists and registered nurses on our platform may issue Absence from Work Certificates (sick/carer’s leave certificates) compliant with Australian law, including the Fair Work Act 2009, under the following conditions:

  • For personal illness/injury or to care for an ill/injured family or household member.

  • Only for cases within the professional scope of a pharmacist or registered nurse.

  • From the time of assessment onward (not backdated or forward-dated).

  • Certificates are not medical certificates and may not be accepted by all employers.

Important:

  • The opinion or certificate issued is provided as a pharmacist or registered nurse, not as a medical practitioner.

  • Our team does not provide a formal “medical certificate.”

  • If you have an ongoing or worsening health issue, consult a doctor.

Please check with your employer before purchasing if a pharmacist or nurse-issued certificate is acceptable for your workplace.

4. Refunds and Cancellations

  • All certificate and digital product sales are final once delivered or downloaded.

  • Refunds cannot be given for errors or omissions made by the user during purchase (e.g., incorrect names, dates, or information).

  • Refunds are not provided if your employer declines to accept certificates issued by a pharmacist or registered nurse.

  • No refund will be given if you choose to no longer require the certificate after purchase, or if you purchased by mistake.

  • As certificates are restricted to the current calendar day only, refunds cannot be provided for disputes about dating or for requests for backdating/future-dating.

  • Cancellation requests will be assessed at our discretion. Refunds may be withheld in cases of suspected misuse, fraud, or breach of Service terms.

5. Eligibility and User Responsibilities

By using our Service, you declare that:

  • You are 18 years or older.

  • You reside in Australia and have a current Australian residential address.

  • You have the legal capacity and authority to agree to these Terms.

  • All information you submit is accurate and kept up-to-date.

6. Certificate Verification, Authenticity & QR Coding

We reserve the right to cancel or mark as invalid any certificate if we uncover false, misleading, or inconsistent information, or if misuse is detected.

  • If a certificate is cancelled, any digital verification (e.g., via QR code) may indicate its invalid status.

  • In such cases, users and third parties will be notified as appropriate.
    Refunds for cancellations caused by user error, fraud, or policy breach will be determined at our discretion.

7. Acceptable Use

You agree to use our Service for legitimate, lawful purposes only. You will not:

  • Violate any local, state, national, or international law.

  • Harm, exploit, or attempt to harm any individual, including minors.

  • Distribute spam, phishing materials, or unsolicited advertising.

  • Impersonate any person or entity, or misrepresent your affiliation.

  • Interfere with, disrupt, or negatively affect the operation of our Service or networks.

  • Introduce any malicious code or attempt to gain unauthorised access.

  • Copy, scrape, or commercially exploit any part of the Service or its content.

We reserve the right to restrict, suspend, or terminate your access at any time for breaches of these Terms.

8. Intellectual Property

All content and materials published on our Service (except user-generated content), including but not limited to logos, branding, website design, text, images, and software, are owned or licensed by Healio Health and protected by copyright, trademark, and other applicable laws.
Any unauthorised use, copying, or distribution is prohibited.

9. Feedback & Submissions

By submitting feedback, suggestions, improvements or ideas to Healio Health, you grant us a perpetual, royalty-free, transferable right to use such submissions in any manner, without compensation or recognition to you.

10. Third-Party Links

Our Service may contain links to other websites or resources not owned by us. We are not responsible for the content, security, or privacy practices of third-party sites. Use these external resources at your own risk.

11. Disclaimers

Our Service, including all content and certificates supplied, are provided “as is” and “as available.”
We make no guarantees regarding uninterrupted access, completeness, accuracy, or suitability for your needs.
Healio Health and its affiliated practitioners disclaim all warranties—express or implied—except as required by law.

We do not guarantee that our certificates will be accepted by every employer or institution; it is your responsibility to confirm acceptance before purchase.

12. Limitation of Liability

Except as required by law, Healio Health is not liable for any indirect, special, incidental, or consequential loss, or damages of any kind arising from your use of the Service. If liability is established, our total liability is limited to the amount paid by you for the relevant product or service.

13. Account Suspension and Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for any reason (including breach of these Terms). Provisions relating to intellectual property, disclaimers, indemnification, and limitation of liability survive termination.

14. Governing Law

These Terms are governed by the laws of Australia. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of Australian courts.

15. Modifications to These Terms

We may modify or update these Terms at any time. The updated Terms will be posted on our website, and your continued use of the Service constitutes acceptance of any changes.

16. General

  • No waiver: A failure to enforce any part of these Terms is not a waiver of Healio Health’s rights.

  • Severability: If any clause is deemed invalid or unenforceable, the remaining clauses will remain in force.

  • Entire Agreement: These Terms constitute the entire agreement between you and Healio Health regarding the Service.
